All rights reserved. Participating in the various newsgroups that make up the Usenet news system without infringing the rights of other users is generally a matter of common sense and courtesy. The vast majority of OpenCRM customers can be expected to appreciate that Usenet is a publishing medium and that a Usenet article is a publication and accordingly to use their own good sense of what is and is not appropriate to guide their decisions about what sort of material to publish. Regrettably, from time to time, articles appear that infringe the rights of others. Examples include, but are not limited to those that contain unsolicited commercial advertising (spam), those that contain pornography or racial abuse, as well as those that infringe copyright or contain libellous statements. Inclusion of material of this sort in a posting is usually described as "abuse" and may also be unlawful in many jurisdictions. This Usenet AUP is based on current "best Internet industry practice" and draws on the collective experience of Usenet users, service providers and the owners and administrators of computer networks, which are used to exchange Usenet articles across the Internet community. Many of these experiences cannot be codified into a formal document. Accordingly, it is not possible to state what is and is not acceptable by reference to such understandings. Additionally, what may have been agreed (whether informally or not) by unidentified individuals who have no legal authority in the relevant jurisdictions is not binding on anyone and does not afford those fixed with liability with a defence in the event that an article is found to be unlawful. While OpenCRM does not wish to form opinions on the content of its customers articles, and always recommends that when a grievance occurs the aggrieved party should try to resolve it directly with the customer, there is certain content which we do seek to restrict because it infringes others rights and/or because we may be held liable if we fail to exercise reasonable care in respect of its publication and/or might jeopardise the position of Software Add-ons Ltd within the Usenet community. In such cases, it is important for the protection of other Internet users that OpenCRM takes firm action to prevent any recurrences. We will enforce appropriate sanctions against any of our customers who are responsible for posting such material. Such sanctions include, but are not limited to, a formal warning and suspension of Usenet access through OpenCRM's machines and suspension of other services provided to the customer by Software Add-ons Ltd and issuing cancel messages in respect of articles originating from our news servers. If a customer's access is suspended, this may later be lifted, at OpenCRM's sole discretion, upon receipt of a formal written undertaking by the customer in question not to post any further offending articles.
